Moody & Knoth, P.C.’s many years of experience has afforded us the opportunity to represent both Sellers and Buyers. Having provided representation for both sides of the transaction affords us with the devil’s advocate insight to the other side of the transaction.

In short, since we are well-versed in the representation of sellers, we are privy to knowledge that allows us to most effectively represent buyers. Conversely, since we are also well-versed in the representation of buyers, we are privy to knowledge that allows us to most effectively represent Sellers.

Buyer Representation

For Sellers, in addition to reviewing and/or drafting the Offer and Purchase & Sale Agreement, we initiate a preliminary title exam to help ensure that any title issues are discovered early enough to be able to address without requiring an extension of the closing date.

We also procure any payoffs, draft the deed and other conveyance documents necessary (Trustee Certificates, Direction of Beneficiaries – as applicable) and afford the Seller the choice not to attend the closing (by drafting and having executed applicable Limited Power of Attorney documents).

We also coordinate the delivery or proceeds funds and communicate on the Seller’s behalf with all parties throughout the sale process.

Seller Representation

For Buyers, in addition to reviewing and/or drafting the Offer and Purchase & Sale Agreement, we handle all elements of the purchase transaction.

As we often will concurrently handle the purchase mortgage loan for the lender our responsibilities include a full title search, preparation and review of financing documents and coordinating all aspects of the closing with the seller, seller’s attorney, the loan officer and the real estate brokers.
