A special needs trust is created to provide for the needs of an individual without adversely affecting that person’s eligibility for Medicaid, Social Security or other government benefits. It is usually created for an adult child with mental or physical disabilities with the goal of preserving eligibility for Medicaid (MassHealth), Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI).

Distribution of Assets
Assets in a special needs trust are distributed to the disabled individual (known as the beneficiary) at the discretion of a trustee. The parents creating the special needs trust will often appoint themselves as the initial trustees. The creators of the trust are also able to appoint a successor trustee in the event the parents predecease the beneficiary.
