Special Needs Trust Attorney, Massachusetts

Special Needs Trusts

A special needs trust is created to provide for the needs of an individual without adversely affecting that person’s eligibility for Medicaid, Social Security or other government benefits. It is usually created for an adult child with mental or physical disabilities with the goal of preserving eligibility for Medicaid (MassHealth), Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI).

The trust attorneys at Moody & Knoth, P.C. can structure a special needs trust to make sure the disabled individual has the provisions necessary to maintain his or her quality of life without sacrificing government benefits.

Distribution of Assets

Assets in a special needs trust are distributed to the disabled individual (known as the beneficiary) at the discretion of a trustee. The parents creating the special needs trust will often appoint themselves as the initial trustees. The creators of the trust are also able to appoint a successor trustee in the event the parents predecease the beneficiary.

Moody & Knoth, P.C. will structure the trust to allow for the payment of items including travel, social outings, cosmetics, and medical treatments (or devices) not covered by the applicable benefit program to afford a quality of life to the beneficiary.  Contact Moody & Knoth, P.C. for a consultation. Our expertise will afford you the peace of mind you deserve.
