Massachusetts Allows Remote Notarization

Enactment of the e-notary law in Massachusetts is a good first step towards the “virtual”, “paperless” closing.  As banks become more familiar with the availability of “virtual” notarization, the reality of paperless closings gets closer to becoming a reality.  In the current pandemic contact-less signings can help business continue while providing a safe environment for borrowers, closing attorneys and bank personnel.

On April 27, 2020, Massachusetts Governor Charlie Baker signed into law an emergency measure to authorize Massachusetts notaries public to use real-time electronic video conferencing to perform “an acknowledgement, affirmation or other notarial act” during the COVID-19 crisis.
